Terms and Conditions
1. The promoter of this prize draw is SCA Investments Limited (trading as Gousto), whose registered address is Unit 1.8 & 1.9, The Shepherds Building Central, Charecroft Way, Hammersmith, London W14 0EE (“Gousto”).
2. The title of this prize draw is: Gousto x Pots & Co Valentine’s Competition 2025.
3. The promotional period for this prize draw begins at 5:45pm on 6 February 2025 (i.e. at the time of the relevant Instagram post where the prize draw is first announced (“The Instagram Post”)) and ends at 00:00 on 14 February 2025 (“Promotion Period”). Entries received after this time will not be accepted.
4. During the Promotion Period, a total of two prizes will be won by one customer (as set out in Clause 10 below). The winner will be selected during a prize draw using a randomised computer process, which will take place on 14 February 2025.
5. This prize draw is only open to legal residents of the United Kingdom aged 18 or over except:
a. employees of Gousto or its holding or subsidiary companies;
b. anyone who benefits from Gousto’s friends & family discount.
6. In addition to Clause 5 above, you will only be eligible to be included in the prize draw if you meet the following criteria:
a. You must follow the Instagram accounts @goustocooking and @pots_and_co at the time of the prize draw;
b. You must have liked The Instagram Post at the time of the prize draw; and
c. You must have commented on The Instagram Post tagging another Instagram account in such a comment.
7. The details of each of the prizes are outlined in Clause 10 of these terms and conditions. The person who receives the prizes during the Promotion Period will, subject to complying with these terms and conditions, be able to claim their prizes as outlined in Clause 8 of these terms and conditions below.
8. The winner will be contacted by Gousto via Instagram direct message through their official Instagram account (@goustocooking) on 14 February 2025 informing them they have won the prize draw. If you are such a winner, you will be asked if you have an active Gousto account. In the event that you do, you will be asked to share your account name and the discount will automatically be applied to the next eight Gousto boxes you order from such an account within 24 hours of you confirming your account details. In the event that you are not already signed up to Gousto, you will be provided with a link that must click on to register for a new Gousto account. Once you have completed registration through this link, the aforementioned discount will automatically be applied to the next eight Gousto boxes you order from such a new account. In respect of the Pots & Co desserts, to arrange delivery, we will request that you send us your full name and address. We will only use this information to send your prize, and it will be held in accordance with our standard data retention policy. Once we have these details, we will send the desserts in two separate deliveries.
9. Each comment on The Instagram Post tagging another Instagram account is equal to a new entry. You may enter the prize draw during the Promotional Period as many times as you may please.
10. Prizes: Details of each prize is as follows:
a. 10 packs of Pots & Co Little Pots of 70% Chocolate Ganache 4 x 50g – we have 1 of this prize to give away.
10 packs of Pots & Co Little Pots of 70% Chocolate Ganache 4 x 50g will be sent to the home address of the winning Instagram account in two different deliveries. No cash alternative is available. Subject to Gousto’s standard terms and conditions for sale of goods: gousto.co.uk/terms-and-conditions
b. Up to 40 meals worth of Gousto (8 Gousto boxes up to a value of £59.80 each) – we have 1 of this prize to give away.
Three months of Gousto boxes is equivalent to eight free Gousto boxes (excluding delivery), up to a value of £59.80 each. Any Gousto credit applied to your account has no official monetary value and cannot be exchanged, transferred, redeemed, replaced or refunded for proper cash. The total cost of each of the eight Gousto boxes will be discounted at checkout when you are ordering each Gousto box. From the date of applying the prize to your account, you will have 3 months to purchase your eight Gousto boxes before it expires. The prize cannot be used in conjunction with any other offers. You will have 7 days to claim such a prize before your 3 month time period commences automatically. 11. Gousto will be supplying the prizes set out in Subclauses 10(a) – 10(b), which shall be governed by Gousto’s Terms and Conditions For Sale of Goods.
12. Prizes may not be claimed by a third party on your behalf.
13. No responsibility can be taken for entries which are misdirected, lost, delayed, damaged or corrupted during delivery to or from Gousto due to any computer malfunction, virus, bug, delay or other reason whatsoever. Gousto is not responsible for any incorrect or inaccurate information supplied to Gousto in connection with this prize draw.
14. To the fullest extent permissible by law, Gousto shall not be liable for any loss or damage whatsoever which is suffered or sustained as a result of participation in the promotion or use of any prize.
15. Gousto’s decision is final with regard to all promotional matters and no correspondence will be entered into. By participating in the prize draw, entrants accept these terms and conditions and are bound by all the rules in full.
16. Gousto reserves the right at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these terms and conditions or the spirit of the prize draws.
17. Gousto must either publish or make available information that indicates that a valid award took place. To comply with this obligation Gousto will send the surname and county of the prize winner to anyone who emails socialteam@gousto.co.uk within one month after the Promotion Period ends. If you object to any or all of your surname or county being made available, please contact Gousto at socialteam@gousto.co.uk. In such circumstances, Gousto must still provide the information and winning entry to the Advertising Standards Authority on request.
18. In the event of circumstances outside the reasonable control of Gousto, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, Gousto reserves the right to cancel or amend the promotion or these terms and conditions, at any stage, but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
19. By participating in the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. Gousto may require you to provide proof that you are eligible. Gousto reserves the right to verify all entries and people and to refuse to award a prize or withdraw a prize entitlement or refuse further participation in the promotion where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. Gousto will be the final arbiter in any decisions and these will be binding and no correspondence will be entered into.
20. Gousto will only process your information as set out in our privacy policy.
21. This promotion, and all the prize draws in connection with this promotion, are governed by English law and are subject to the exclusive jurisdiction of the English courts.
22. These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of these terms and conditions and by participating, all entrants will be deemed to have accepted and be bound by these terms and conditions.
